7.  JUDGING/DETERMINING THE FINALISTS: At the end of the Entry Period, a panel of qualified judges (“Judges”), selected by the Sponsor, in its sole discretion, will score each Submission up to the maximum number of points allowed.  Judges will review and judge all eligible Submissions based on the following judging criteria (“Judging Criteria”):

  • Creativity and Originality in your Content, showing us how your (or your child’s) hockey hair is unique to you (your child), your/their fandom, and your/their personality (45%)

  • Demonstrating your/your child’s Passion for Hockey and Hockey Hair and how that passion enhances your/their fandom (35%)

  • Overall Quality and Appeal of your Content (20%)

Submissions that do not contain all required information or are considered inappropriate or do not meet the guidelines of these Official Rules for any reason are not eligible. In the event of a tie among two (2) or more Submissions, the Submission with the higher score for Creativity and Originality will be the winner between or among the tied Submissions. If there is still a tie, the Submission with the higher score for Demonstrating your/your Child’s Passion for Hockey and Hockey Hair will be the winner between or among the tied Submissions.  In the event that a tie still remains, an additional “tie-breaking” judge will be brought in to evaluate the tied Submissions, based on the Judging Criteria above. The top twelve (12) Submissions with the highest overall scores from the Judges will be deemed the potential finalists (“Finalists”). Finalists will be eligible to move on to the Voting Period. Finalists will be notified by the Sponsor via Direct Message via the social media platform used to enter, within twenty-four (24) hours after the Judging Period ends (“Finalist Notification”). If a Finalist fails to respond to the Finalist Notification within twenty-four (24) hours or the Finalist otherwise fails to comply with these Official Rules, his/her Submission will be disqualified and the Submission with the next-highest score will be selected as a Finalist. As part of the Finalist notification process, each potential Finalist (and/or parent/legal guardian of potential Finalist if he/she is over eighteen (18) yet still a minor in his/her place/jurisdiction of residence) will be required to complete and submit a redemption form (“Redemption Form”) as a condition of becoming a Finalist and, for all methods of entry, will be required to upload their Submission with the Redemption Form. If any potential Finalist fails or refuses to sign and return such Redemption Form (and release, as applicable) and their Submission (if applicable) within twenty-four (24) hours of date of notification or if the Redemption Form is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential Finalist, may be disqualified and an alternate potential Finalist may be selected, if time permits. P.O. Boxes are not permitted. The Contest Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s social media account to receive messages. For Residents of Canada: Each potential Finalist must answer correctly, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question (“Skill Testing Question”). If potential Finalist fails to correctly answer the Skill Testing Question, they will be disqualified and an alternate potential Finalist will be selected using the process above.

During the Voting Period, Sponsor will post the twelve (12) Finalists to their website https://www.greatclips.com/hockeyhair (“Website”). To vote during the Voting Period, you must be a legal resident of the fifty (50) United States (excluding Puerto Rico) or the District of Columbia, or Canada (excluding Quebec), eighteen (18) years of age or older, at the time of voting. During the Voting Period, follow the Sponsor’s instructions, which may include, but not limited to, creating an account on the Website, with your email address, confirming you are eighteen (18) years of age or older, and agreeing to the Official Rules and Sponsor's Privacy Policy (“Voting Account”), to place one (1) vote for your favorite Finalist that you feel best embodies the spirit of the Contest. You will only need to complete the Voting Account one (1) time.  Each voter may vote one (1) time per day during the Voting Period. Voters who come back on subsequent days will only need to log-in with their email address and password and follow the instructions to vote. Votes received from any person in excess of this limitation will be void. Votes generated by script, bot, macro or other automated means are void. Voting must be completed by the actual person casting the vote. A person may not vote on behalf of another person. Subsequent votes by a single voter in the same day will be disqualified. Votes intended to impact the integrity of the voting process as determined by Sponsor in Sponsor’s sole discretion are void. Payment or other consideration in exchange for votes is prohibited and if a Finalist does provide, or is suspected of providing, payment or other consideration in exchange for votes directly or indirectly, he/she will be disqualified.

At the end of the Voting Period, Sponsor will audit and review votes to ensure proper integrity was maintained. Sponsor reserves the right to disqualify any Submission it suspects the creator of the Submission or any voter of acting in an unsportsmanlike manner during the entire Contest Period, including, but not limited to, encouraging voting fraud, making inappropriate comments on the Sponsor’s or other’s social media accounts, or otherwise not acting in compliance with these Official Rules, in Sponsor’s sole and absolute discretion.

The six (6) Finalists with the highest number of votes, as determined by the Sponsor, will be deemed the potential Grand Prize winners. Sponsor reserves the right not to award all prizes or to choose fewer than twelve (12 Finalists and six (6) winners if, in its sole discretion, it does not receive a sufficient number or quality of eligible and qualified Submissions. Prize awards are subject to verification of eligibility and compliance with these Official Rules.

8.  WINNER NOTIFICATION: The potential Grand Prize winners will be notified via email (or another method to be selected by Sponsor in its sole discretion) in a commercially-reasonable time after the selection of the potential winners. The Contest Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information.  Notification is deemed to have occurred immediately upon sending of an email or a direct message on social media, or the placing of a phone call, one (1) day after sending via a delivery service.

Each potential Grand Prize winner (and/or parent/legal guardian of potential winner if he/she is over eighteen (18) yet still a minor in place/jurisdiction of residence) will be required to sign and submit a declaration of eligibility/liability release and a publicity release (collectively, the “Declaration”) (which will include a release form relating to publication of the name and image of the minor child, if applicable) and return it within two (2) days before being eligible to receive his or her prize.  Grand Prize winners’ guests or their parent/legal guardian(s) may also be required to sign a travel, liability release, and publicity release (collectively, the “Release”).  If any potential winner or guest (or parent or legal guardian of guest) fails or refuses to sign and return the Declaration or Release within the required time period or if the prize or prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to the potential winner, potential winner may be disqualified and an alternate may be selected.  Non-compliance may result in disqualification and award to an alternate winner.  A potential winner becomes a “winner” only after verification of eligibility by Sponsor. If a potential winner cannot be contacted within a reasonable time period, if the potential winner is ineligible, if any notification is returned undeliverable, or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit the prize and an alternate potential winner may be selected from among all remaining Submissions repeating the process identified above. No more than the stated number of prizes will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available may be selected via a judging process such as described above from among all persons making purportedly valid claims for such prizes. Inclusion in such judging process shall be each entrant’s sole and exclusive remedy under such circumstances. 14. GOVERNING LAW AND LIMITATION OF LIABILITY:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Contest will be governed by and construed in accordance with the internal laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

BY ENTERING THE CONTEST, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00 USD), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

15. DISPUTE RESOLUTION: The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in the State of Minnesota, and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.  The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Contest shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually-agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in the State of Minnesota. The federal or state law that applies to these Official Rules will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in the State of Minnesota. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing).  Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

By participating in the Contest, participant agrees to all of the terms and conditions of the Sponsor’s Privacy Notice, which is available at https://www.greatclips.com/privacy-notice. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.

18. DATES & DEADLINES/ANTICIPATED NUMBER OF PARTICIPANTS: Because of the unique nature and scope of the Contest, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Contest.  Sponsor cannot accurately predict the number of entrants who will participate in the Contest.

19.  FURTHER DOCUMENTATION: If Sponsor shall desire to secure additional assignments, certificates of engagement for the Submission or other documents as Sponsor may reasonably require in order to effectuate the purposes and intents of these Official Rules, then entrant agrees to sign the same upon Sponsor’s request therefor.

20. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules or the Declaration will not affect the validity or enforceability of any other provision.  In the event that any provision of the Official Rules or the Declaration is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.  Entrants agree to waive any rights to claim ambiguity of these Official Rules.  Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
